Over Ginsburg's Dissent, Court Limits Bias Suits

The court ruled 5 to 4 that Lilly Ledbetter, the lone female supervisor at a tire plant in Gadsden, Ala., did not file her lawsuit against Goodyear Tire and Rubber Co. in the timely manner specified by Title VII of the Civil Rights Act of 1964.

..."In our view, the court does not comprehend, or is indifferent to, the insidious way in which women can be victims of pay discrimination," she [Ruth Bader Ginsburg] said.

Last month, Ginsburg rebuked the same five-justice majority for upholding the federal Partial Birth Abortion Ban Act and for language in the opinion that she said reflected "ancient notions about women's place in the family and under the Constitution -- ideas that have long since been discredited." [Whatever the hell that means]

Yesterday she said that "Title VII was meant to govern real-world employment practices, and that world is what the court today ignores." She called for Congress to correct what she sees as the court's mistake.

In a case that Justice Samuel A. Alito Jr. said was easily decided on the statute "as written," her statement from the bench was noteworthy.

...She noted Ginsburg's background as a feminist legal activist who helped establish women's legal rights and added: "To see them being dismantled is especially troubling."


[How did a feminist activist get on the Supreme Court?! Why does she think the Supreme Court is supposed to interpret law the way she personally wishes it worked, not the way it is actually written? Is it really that hard to read words? What an idiot!

She does get it half right in asking Congress to change the law, but for the wrong reason. Congress would not be "correcting" the Court, it would be correcting the law, if it is in fact unfair. If you don't like the law, get Congress to change it, don't legislate from the bench! ]

Jack in the Box Ads Called Misleading

The parent company of the Carl's Jr. and Hardee's fast food chains sued rival Jack In The Box Inc. on Friday to stop TV ads that it says suggest Carl's Jr. and Hardee's use cow anus to make Angus beef hamburgers.

CKE Restaurants Inc. sued Jack In The Box in U.S. District Court on Friday over an ad in which executives laugh hysterically at the word "Angus" and another where the chain's pingpong ball-headed mascot, Jack, is asked to point to a diagram of a cow and show where Angus meat comes from.

"I'd rather not," the pointy-nosed Jack replies.

The employee asking the question traces a circle in the air with his pen while pronouncing the word Angus.

CKE claims the ads create the misleading impression that Jack In The Box's new 100 percent sirloin burgers use a better quality of meat than the Angus beef used by Carl's Jr. and Hardee's. CKE claims the spots confuse consumers by comparing sirloin, a cut of meat found on all cattle, with Angus, which is a breed of cattle.

A former Democratic Party activist who left dog feces on the doorstep of U.S. Rep. Marilyn Musgrave's Greeley office during last year's 4th Congressional District campaign was found not guilty Wednesday of criminal use of a noxious substance.

...Ensz's lawyers never denied that their client left a Musgrave campaign brochure full of feces at the front door of the congresswoman's office. But they argued that Ensz was making a statement protected by free speech - the poop was a symbol of what she thought of Musgrave's politics.

"Her only intention of going over there was to make a political statement that Marilyn Musgrave's politics stink," attorney Shannon D. Lyons said after the verdict.

...Hoff defended Ensz's actions as protected free speech but not the tactic.

Four white lions born in French zoo

Four white lions were born in a zoo in western France at the weekend, providing a welcome boost for the species whose population is teetering at about 30 worldwide, a zoo official said Wednesday.

The male and three female cubs, white as snow and weighing about 1.5 kilos (3.3 pounds), were separated from their mother at birth because she appeared to lack parenting skills.

"Nyala, their mother, wasn't taking care of them. It's as if she didn't know what to do," said Bernadette Oury, director of the Jurques zoo in western France where the four were born on Sunday.


Newborn saved by a trunk call

A SQUEALING newborn elephant is dramatically rescued — after his mother tried to CRUSH and DROWN him.

African elephant Pori, 26, gave birth to the 250lb baby at a zoo, but seconds later the three-ton mum appeared to stomp on him.

Then she rolled him through her enclosure like a beachball and pushed him underwater.

Keepers grabbed the half-drowned tot by the trunk and pulled him to safety.

But he was later REUNITED with his mum — who killed her first baby in 2005 by accidentally crushing him — after being given the all-clear by vets.

A spokesman for the zoo in Berlin, Germany, said Pori had been trying to stimulate the baby to stand up, adding: “She is a proud and loving mother now.”


What is up with these mother animals being so terrible?!

(AP) An man who allegedly included dog feces along with his payment for a parking ticket has been charged with disorderly conduct. The 22-year-old man was charged with the misdemeanor May 11 in a criminal complaint filed in Mower County District Court.

The man's vehicle was ticketed on April 18 while it was parked in front of his residence. He put an envelope containing his payment and dog feces in a drop box at the law enforcement center, the complaint stated.

But while Zoo has drawn big, curious crowds at its screenings, the real unsettling quality about the movie is its approach: it depicts the men in a sympathetic light, one that tries to push the viewers to understanding their sexual perversion.

...Independent filmmaker Robinson Devor shies away from prurient imagery, instead enveloping the story in rich photography that gives it a dreamlike beauty overwhelming the sordidness of the subject matter.

...He said the absence of judgement was a deliberate choice, one reinforced after he watched some of the actual videos the men had taken of their horse sessions - footage that doesn't make it into the film, apart from the barest of glimpses at one point.

"They showed us the videos not to show us pornography, but to show an animal that wanted to be with them," Devor said, though he added that he kept some scepticism about the taped acts.

"We don't know what the conditioning was (for the horses)."

..."They've crafted a subdued, mysterious and intensely beautiful film that presents bestiality not for the purpose of titillation but as a way of investigating the subjective nature of morality," the movie trade magazine Variety wrote.

...The men heard in the film are remarkably honest about their motivations. One of them argues "mammal to mammal" love should not be seen as wrong.

Another firmly rejects the tag "bad person" rhis employer lays upon him before he is sacked. They all say the horses were willing participants.

Indeed, the only judgement seemingly expressed in the documentary is not on the matter in the stable at all. It is in fleeting radio references to US President George W Bush's "war on terror" and the presumed complicity-for-profit of big companies such as Boeing.

Even the cast ended up feeling compassion for the men depicted in Zoo.

...In the small, northern desert town of Huachichil, migrant recruiter Rene Urbano encouraged Mexicans who work in potato fields and apple orchards to continue signing up for possible visas, arguing that he would work to find them jobs with U.S. employers.

"They are rewarding those who are doing things wrong and abandoning my boys who need work," he said, adding that there are millions of migrants waiting for U.S. jobs.

France surrenders again

Paris festival called off after anti-American threats

A Paris festival celebrating US music and culture has been called off following a series of anti-American threats, organisers said on Sunday.

...Organisers issued a statement saying they were forced to postpone the event following "persistent pressure and threats of an anti-American nature".

"At first we thought it was a joke when we received a letter with a mixture of threats, mentioning Al-Qaeda and full of spelling mistakes," said Chantal Tenot, the festival's press officer.

But after several threatening phone calls the organisers decided Friday to file a police complaint and call off the event.

Canadians don't care for Sicko

...We Canucks were taking issue with the large liberties Sicko takes with the facts, with its lavish praise for Canada's government-funded medicare system compared with America's for-profit alternative.

While justifiably demonstrating the evils of an American system where dollars are the major determinant of the quality of medicare care a person receives, and where restoring a severed finger could cost an American $60,000 compared to nothing at all for a Canadian, Sicko makes it seem as if Canada's socialized medicine is flawless and that Canadians are satisfied with the status quo.

Moore makes the eyebrow-raising assertion that Canadians live on average three years longer than Americans because of their superior health care system.

I suggested to Moore that Sicko makes Canada's health system look so great, it wouldn't be surprising if Prime Minister Stephen Harper – of whom Moore is no fan – handed out DVD copies of it as campaign material in a future election.

Other Canadian journalists spoke of the long wait times Canadians face for health care, much longer than the few minutes Moore suggests in Sicko. Moore, who has come under considerable fire for factual inaccuracies in his films, parried back with more questionable claims.

More cute baby animals rejected by their mom




BEIJING (AP) - It's a dog's life for three newborn tiger triplets in eastern China. The cubs, whom officials at the Jinan Paomaling Wild Animal World in Shandong province are so far just calling "One," "Two" and "Three," have been nursed by a dog since they were rejected by their tiger mother shortly after birth, said Paomaling manager Chen Yucai.

The trio's adoptive mother, a mixed breed farm dog called "Huani," is expected to nurse them for about a month or until their appetites outpace her supply, Chen said.

Chen said it is common for Chinese zoos to use surrogate dog mothers to nurse rejected tiger cubs and that Huani has nursed tigers before.

In the past, Paomaling put dog urine on their rejected cub's fur to make the surrogate think she was nursing one of her own puppies but the zoo didn't bother with Huani because she seemed not to mind nursing the tigers, he said.

Prenatal Test Puts Down Syndrome in Hard Focus

...About 90 percent of pregnant women who are given a Down syndrome diagnosis have chosen to have an abortion.

Convinced that more couples would choose to continue their pregnancies if they better appreciated what it meant to raise a child with Down syndrome, a growing group of parents is seeking to insert their own positive perspectives into a decision often dominated by daunting medical statistics and doctors who feel obligated to describe the difficulties of life with a disabled child.

They are pressing obstetricians to send them couples who have been given a prenatal diagnosis and inviting prospective parents into their homes to meet their children. In Massachusetts, for example, volunteers in a “first call” network linking veteran parents to new ones are now offering support to couples deciding whether to continue a pregnancy.

The parent evangelists are driven by a deep-seated fear for their children’s well-being in a world where there are fewer people like them. But as prenatal tests become available for a range of other perceived genetic imperfections, they may also be heralding a broader cultural skirmish over where to draw the line between preventing disability and accepting human diversity.


It's surprising how cold hearted doctors are when it comes to stuff like this.

Man Dies in Parking Lot Dance Competition

NEW BRITAIN, Conn. — A man died while trying to outdo a rival with an acrobatic move while "battle dancing," police said.

Robert Stitt, 48, and his rival were competing in a parking lot Monday night when he tried a forward flip and landed on his head.

"It was just two guys dancing. Everybody was laughing," Stitt's friend John Boxley said.

Boxley said James Brown was on the radio and Stitt wanted to outdo a rival dancer, who had flipped in the air.

A controversial religious figure who claims he is Jesus Christ incarnate with a following of millions with "666" tattoos on their bodies, filled an amphitheater in Orlando this weekend, and promised joy, peace and prosperity.

...Miranda said millions of people worldwide have tattooed their bodies with "666" in recognition that the second-coming of Christ has taken place, according to the report.

"I have it proudly on my hand," a believer told Local 6's Jamie Guirola. "It is easier when they shake my hand. It is easier for them to ask. I am very proud to show it is a sign of love."

...Miranda said he is known as God in at least 30 countries.

Local 6 reported that he was born in Puerto Rico and admits to being a recovering heroin addict. He also spent times in prison on drug and petty theft charges.

Miranda is the founder of the Miami-based Growing in Grace Ministry.

Uh, do these people not know that 666 is the sign of the ANTI-CHRIST and NOT the 2nd coming?!

Plaintiff Roy Pearson, a judge in Washington, D.C., says in court papers that he's been through the ringer over a lost pair of prized pants he wanted to wear on his first day on the bench.

He says in court papers that he has endured "mental suffering, inconvenience and discomfort."

He says he was unable to wear that favorite suit on his first day of work.

He's suing for 10 years of weekend car rentals so he can transport his dry cleaning to another store.

..."People in America are now scared of each other," legal expert Philip Howard told ABC News' Law & Justice Unit. "That's why teachers won't put an arm around a crying child, and doctors order unnecessary tests, and ministers won't meet with parishioners. It's a distrust of justice and it's changing our culture."

The worst part about this story is that this guy is a JUDGE! That tells you a lot about our legal system right now.
